নাথ ব্যাংক লিমিটেড

বাঙ্গালীর ব্যাংক ব্যবসার এক অসাধারন প্রয়াস ছিল নাথ ব্যাংক লিমিটেড। ১৯২৬ সালে প্রতিষ্ঠিত এই ব্যাংক একটি তফসিলভূক্ত ব্যাংক ছিল এবং কলকাতা ক্লিয়ারিং হাউজেরও সদস্য ছিল। আর অসাধারন বিষয় হচ্ছে এই ব্যাংকের প্রধান কার্যালয় ছিল নোয়াখালীর চৌমুহনীতে- কারন এ ব্যাংকের প্রতিষ্ঠাতা ও ম্যানেজিং ডিরেক্টর ছিলেন নোয়াখালীর সন্তান ক্ষেত্রনাথ দালাল।

নাথ ব্যাংক লিমিটেড ১৯২৬ সালে ইন্ডিয়ান কোম্পানি আইন ১৯১৩ এর অধীনে নিবন্ধিত হয়। এর মূলধন ছিল ২৫,০০,০০০ রুপি। (প্রতিটি শেয়ার ২৫ রুপি হিসেবে)। ১৯৪৭ সাল পর্যন্ত এই ব্যাংকের সাফল্য ছিল লাভজনক ব্যবসার এবং সুনাম ও আস্থার। ফলে অবিভক্ত বাংলা সহ ভারতের বিভিন্ন অঞ্চলে এর শাখা বিস্তৃত ছিল। নোয়াখালীর দাঙ্গা এবং দেশভাগের ডামাডোলে ব্যাংকটি তাদের প্রধান কার্যালয় কলকাতায় স্থানান্তর করে নেয়।

কিন্তু দেশ ভাগ পরবর্তীতে নোয়াখালী, কুমিল্লা ত্রিপুরা, এবং চট্টগ্রামে বেশ অনেকগুলো শাখা ফেলে যাওয়ার কারনে ব্যাংকটিতে সম্পদ এবং দেনা ইত্যাদির সমন্বয়ে যথেষ্ট অসামঞ্জস্যতা দেখা দেয় এবং তাতে ব্যাংকটি নানাবিধ আর্থিক টানাপোড়নে পরে যায় এবং এক সময় তা যথেষ্ঠ অস্থিতিশীল পরিস্থিতির সৃষ্টি করে।

অর্থনীতিবিদ অরুণ ঘোষ এই ব্যাংকের পতনকে শাখা ব্যাংকিংয়ের অত্যধিক সম্প্রসারণকে দায়ী করেছেন। নাথ ব্যাংকের ব্যর্থতা বিনিয়োগকারীদের মধ্যে আতঙ্ক তৈরি করেছিল। যার ফলে শেষ পর্যন্ত ১৯৫০ সালে ব্যাংকটি ভারতীয় রিজার্ভ ব্যাংকের অবসায়নের (লিকুইডিশনের) আওতায় আসে এবং ১৯৫৪ সালের ১৬ জুলাই যবনিকাপাতের অস্বাভাবিক পরিণতি মেনে নেয়। নাথ ব্যাংক লিমিটেড যে আইনের মাধ্যমে অবসায়ন (লিকুইডিশন) হয় সেটি নিম্নে তুলে ধরা হলো-

The Judgment of the Court was delivered by Lahiri, J.:—
This’ is an appeal by the Nath Bank Ltd. (In Liquidation) through its Court Liquidator against an order of Bachawat, J., dated July 16, 1954, rejecting the appellant’s contention that under section 45H of the Banking Companies Amendment Act it is not necessary for the appellant to adduce any evidence in the first instance and that it is for the Respondents to begin their case and to prove that they are not guilty of misfeasance.

The facts of the case, which are not in dispute, are as follows:— On the 4th May, 1953, the Official Liquidators of the Bank took out a Master’s summons for a misfeasance proceeding under section 235, Indian Companies Act, against the Respondents praying for an order compelling the Respondents and each of them to reply or restore a total sum of Rs. 2,19,59,612-7-8, or such other sum as the Court might fix, to the assets of the said Bank and for various other reliefs. On August 27, 1953, S.R Das Gupta, J., made an order to the effect that the matter should be set down for trial on evidence on December 16, 1953, Bachawat, J., passed an order to the effect that for the purpose of shortening the trial, the parties agreed that copies of relevant documents relied upon by the petitioner should be annexed to a further affidavit to be affirmed by or on behalf of the petitioner and thereafter the order runs.
